Please review these Terms of Purchase very carefully.  By purchasing our products and/or services, you are agreeing to these and are expressing that you have been given reasonable access to review these terms prior to your purchase. These Terms are binding as of the date you purchase or access our products and/or services.

SECTION 1 - General Purpose

These Terms are between you (“Purchaser,” “You,” “Your”) and HaruCreationsJa (“Company,” “We,” “Us,” “Our”) for the purpose of purchasing or otherwise obtaining digital products and/or services (our “Products”) whether through our website at www.harucreationsja.com or any related domains or subdomains (the “Website”), or in person. HaruCreationsJa and the Purchaser will collectively be referred to as “Parties,” and each individually as a “Party.” 

By clicking “Add to Cart,” “Buy Now,” or any other phrase on the purchase button, submitting a payment electronically or in-person, or otherwise subscribing through the Website, you are agreeing to adhere to and be bound by following terms and conditions, together with the Terms of Use and our Privacy Policy, all of which are hereby incorporated by reference (collectively,  the "Terms").

SECTION 2 - Scope of Product & General Service

Our Digital Products include but are not limited to: eBooks, templates, educational guides and resources, online courses, and other digital products for purchase or download. And services including content planning and/or scheduling, copywriting, customer service, marketing strategizing, and more as an independent contractor.

SECTION 3 - Terms of Purchase

These Terms of Purchase govern your rights and responsibilities regarding, product/service delivery, refunds, chargebacks, the reserved right to delay service, and final purchases for products and services offered by HaruCreationsJa ("Company", "Us", "Our" or "We"). By making a purchase on our website, you agree to adhere to these terms:

3.1 Product Delivery

• Digital Product Delivery: When you make a purchase and submit your payment, you will receive a link to download the Products. For more information, please refer to your receipt of purchase delivered by email. If the Product is listed as presale or pre-order, the order will be delivered as detailed on the Website. The Company will make all reasonable efforts to meet any estimated delivery dates. Should the Company be unable to meet estimated timelines for delivery of presale Products, the Company will have the sole discretion as to whether to issue a refund.

• Service Delivery: After the signing of a contract and the arranged payment plan has been initiated with the first required payment a meeting will be arranged to discuss timelines for delivery. 

3.2 Refunds

• Service Refunds: We offer a 3-day refund policy for services, whereas if you are not satisfied with your purchase of a service, you may request a refund within 3 days of the payment date via harucreationsja@gmail.com.

• Digital Product Refunds: For digital products delivered after purchase refunds are not offered. However, we want to make sure that you’re satisfied with your template. If you find that your template doesn’t meet your needs or you have any issues with editing it, reach out via harucreationsja@gmail.com 

3.3 Chargebacks

• By attempting a chargeback with your financial institution, you are expressly agreeing to pay the full cost of your original purchase, plus any fees or associated costs incurred by the Company. We have the right to present these Terms to your financial institution, any payment processing company and/or investigating agency concerning the attempted chargeback or financial dispute.  

3.4 Delay of Service

• In the event of unforeseen circumstances that result in a delay of our services, we will communicate the delay to affected customers and provide an estimated timeline for service completion. We are not liable for any incidental or consequential damages resulting from service delays.

3.5 Final Purchases

• All purchases of digital products made on our website are considered final once the product or service is delivered. The final purchase of a service is based on the individual contract per service contract. Any exceptions to this policy will be outlined in specific product/service descriptions.

SECTION 4 - Payment + Billing

By providing the Company with your preferred payment method, you represent that you: (i) are authorized to use, and (ii) authorize the Company to charge that payment method (the “Authorized Payment Method”) for any fees related to your purchase of the Products, including without limitation fees relating to any paid feature of the Website and/or retainer service of the Company in which you have chosen to enroll (collectively, the “Fees”).
If you are taking advantage of any limited-time trial-period offer and you do not cancel the service on or before the last day of the trial period, you are authorizing us to charge your payment method for the service.

SECTION 5 - No Warranties + No Guarantees

HaruCreationsJa is providing the Products on this Website on an “As-Is” basis for individual use by the Purchaser at their own risk and without any warranties, whether express or implied, including, but not limited to warranties of title; merchantability; fitness for a particular use; or any rights or licenses in these Terms.  We make no warranty as to the accuracy and reliability of information set forth in the Products, the Website, and Company-related documentation.  You understand and agree that purchasing the Products does not guarantee specific results, including financial or other business gains for you personally and/or for the business. The information included in the Products is provided for informational purposes only and you are responsible for implementing any business practices or suggested actions found within these Products

SECTION 6 - Disclaimer of Liability

HaruCreationsJa and its owner, Harta-Lee Guthrie, disclaim all liability for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our website, products, or services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.  If you do have questions about your particular situation, you should consult with an attorney licensed in your state who can review the specifics of your situation and give you tailored legal advice. 

SECTION 7 - Dispute Resolution & Governing Law

7.1 Dispute Resolution

• Negotiation: In the event of any dispute arising under or in connection with these terms, the parties agree to negotiate in good faith to resolve the dispute.

• Mediation/Arbitration: If negotiation is unsuccessful, the parties agree to attempt to resolve the dispute through mediation or binding arbitration in accordance with the rules of e-Mediation services available in the time zones of all parties, before resorting to litigation.

7.2 Governing Law
This agreement is governed by and construed in accordance with the laws of Jamaica, WI. Any legal actions or proceedings related to this agreement shall be brought in the state or federal courts located within Jamaica, WI.
